Tourism Services include activities, guest accommodation, and any other services and facilities purchased from or through Musangano Lodge. Musangano Lodge is duly incorporated under the laws of Zimbabwe. It offers a range of tourism facilities, including, but not necessarily limited to activities and guest accommodation referred to as “Tourism Services” on the following terms and conditions. 1. The tourism services purchased from or through the company are subject to an element of unpredictability. Accordingly, the company reserves the right to modify or vary or, if necessary, to cancel any of the tourism services procured from or through it in order to adapt to changed circumstances or or to enhance the experiences afforded to the client or to protect the clients well-being. 2. The nature and location of the services purchased from or through the company entail an element of hazard, which may result in any of the following: death, illness, injury, discomfort, inconvenience or disappointment and/or property being stolen, lost, destroyed or damaged. 3. A client of the company may at any time be precluded from using or participating in any of the tourism services purchased from or through the company if, in the opinion of an employee or representative of the company, the physical or mental condition of the client renders him incapable of caring for himself, a hazard to himself or herself or other clients, or objectionable to other clients. 4. The company shall not be liable for damages in respect of any loss whatsoever suffered or expenses incurred by a client by reason of : 4.1. any modification, variation or cancellation of any tourism services as provided in Clause 1; or 4.2 any hazard described in Clause 2; or 4.3 the client being precluded, in terms of clause 3, from using or participating in any tourism services. 5. The guest, by signing this registration card, warrants that he is duly authorized to sign for and bind all persons represented by him or for whom he is responsible (his party) to these conditions of residence and failing such authority, agrees to be personally liable for all amounts arising from the residence of himself and his party at the lodge. 6. Any reasonable complaint about any services, facilities and activities offered by or procured through Musangano Lodge must be made in writing and handed to an appropriate representative of Musangano Lodge immediately, or forwarded to the nearest office of the Company within 14 days after checking out of the lodge. 7. The guest hereby agrees on behalf of himself and the members of his party: i) to pay not later than the time of departure (unless prior written arrangements have been made with management) the unit or room rate which has been determined by the lodge for the period of residence, the costs of food, beverages and any other amounts relating to such residence together with VAT (if applicable) incurred by the guest and his party during his stay in the lodge. Periodic payments must be made if the amount exceeds the credit limit designated by the lodge, and accounts are payable on presentation. ii) a certificate from the lodge manager shall constitute proof of indebtedness of the guest and/or his party and of the particulars therein for all purposes including any action instituted by the lodge against the guest and/or his party. iii) that after his departure, the lodge may retain goods left behind by him and/or his party authorises the hotel after giving one month’s notice to the address registered by the guest of its intention to do so, to sell same, privately or publicly, at the lodge’s discretion at such price as the lodge may determine and offset proceeds of such sale against possible indebtedness of the guest for those proceeds failing which they shall be deemed to have been forfeited to the lodge. iv) that as a condition of his residence at the lodge that the lodge shall not be responsible for any injury to or death of any person or the loss or destruction of or damage to any property upon the premises, whether arising from fire, theft or any cause and by whomsoever caused or arising from the negligence (gross or otherwise ) or a wrongful act of any person in employment of the lodge. 8. Notwithstanding the a foregoing the lodge shall have the right of instituting all or any proceedings with regard to such stay in the lodge subject to the laws of Zimbabwe and the jurisdiction of the High Court of that country. |
